Welcome to North Adventures.
North Adventures is operated by North Auto Electrics Pty Ltd, trading as North Adventures ("North Adventures", "we", "us" or "our").
These Terms of Service ("Terms"), together with our Privacy Policy, Shipping Policy and Returns, Refunds & Warranty Policy, set out the terms that apply when you access our website, use our services or purchase products from us.
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.
Please read these Terms carefully before using our website or placing an order. By accessing or using our website or purchasing from North Adventures, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
1. Access & Use of Our Website
You may use our website only for lawful purposes and in accordance with these Terms.
When providing information through our website, including when creating an account or placing an order, you agree to provide information that is accurate, current and complete.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.
You must not use our website in a way that interferes with its operation, compromises its security, infringes the rights of another person or is otherwise unlawful.
We may restrict or suspend access to our website where reasonably necessary to protect our business, customers, systems or other users.
2. Products & Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images, pricing and other information displayed on our website are accurate and current.
However, product manufacturers may update specifications, designs, packaging or components from time to time. Images may also appear differently depending on your device and display settings.
Minor variations in colour, appearance, packaging or manufacturer-supplied product details may occur where they do not materially change the nature or performance of the product.
Where a material error is identified in product information before an order is fulfilled, we will contact you where appropriate to discuss the available options.
Nothing in this section limits your rights where a product does not match its description or otherwise fails to meet a consumer guarantee under the Australian Consumer Law.
We may discontinue products or change the products we offer at any time.
3. Product Suitability & Customer-Supplied Information
Many products sold by North Adventures are technical products designed for specific applications, including electrical, solar, battery, communications, 4WD and touring systems.
Customers are responsible for reviewing available product specifications and considering whether a product is suitable for their intended application before purchasing.
Where you ask North Adventures for product recommendations, compatibility advice or assistance designing or selecting components, our advice will be based on the information you provide to us.
You are responsible for providing complete and accurate information about your intended application, vehicle, system voltage, existing equipment, system configuration, expected loads and any other relevant requirements.
We cannot reasonably account for information or circumstances that have not been disclosed to us.
Nothing in this section limits any rights you may have where you reasonably rely on advice provided by North Adventures and that advice gives rise to rights or remedies under the Australian Consumer Law.
4. Technical Information, Guides & Calculators
North Adventures may provide guides, articles, calculators, product comparisons, installation information and other technical or educational content.
Unless expressly stated otherwise, this information is provided as general guidance and should be considered alongside the specifications and instructions provided by the relevant product manufacturer and the requirements of the individual application.
Calculators and estimated outputs may rely on assumptions, user-supplied information and typical operating conditions. Actual performance may vary due to factors including weather, temperature, shading, equipment efficiency, installation conditions, system configuration and usage.
Customers should verify critical specifications and requirements before purchasing or installing a product.
Where installation or system design requires specialised knowledge, professional assessment may be appropriate.
Nothing in this section excludes any liability or responsibility that cannot lawfully be excluded.
5. Orders & Order Acceptance
When you place an order through our website, you are making an offer to purchase the products in your order.
You will generally receive an automated order confirmation after checkout. This confirms that we have received your order but does not necessarily mean that the order has been finally accepted or dispatched.
We may decline or cancel an order where reasonably necessary, including where:

Where we cancel an order after payment has been received and no goods have been supplied, we will refund the applicable amount paid.
We will not cancel an accepted order arbitrarily or for a reason prohibited by law.
6. Fraud Prevention & Order Verification
To protect our customers and business from fraudulent transactions, we may conduct reasonable verification checks before accepting or dispatching an order.
Where an order is identified as presenting an elevated fraud or payment risk, we may contact you to verify information relating to the order or payment.
We may delay, decline or cancel an order where we are unable to reasonably verify the transaction or where we reasonably believe the transaction may be fraudulent or unauthorised.
Any personal information collected or used for fraud prevention will be handled in accordance with our Privacy Policy and applicable law.
7. Prices, Payments & Pricing Errors
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars and include GST where applicable.
Shipping and other applicable charges will generally be displayed at checkout or communicated to you before an order proceeds where a separate freight quote is required.
We make reasonable efforts to ensure pricing is accurate. However, genuine errors may occasionally occur.
Where a product has been displayed or sold at a price that is clearly the result of an error, we may contact you before fulfilment to explain the error and offer you the opportunity to proceed at the correct price or cancel the affected item for a full refund.
We will not rely on this provision to avoid honouring legitimate advertised pricing or promotions.
Prices and promotions may change from time to time. Changes will not affect orders already accepted except where permitted by law or agreed with you.
8. Shipping & Delivery
Shipping and delivery are governed by our Shipping Policy, which forms part of these Terms.
Delivery timeframes are estimates unless we expressly agree otherwise.
We use Australia Post and a range of courier and freight providers. Some orders may be dispatched directly from a supplier or from multiple warehouse locations and may arrive in separate shipments.
We will assist with reasonable enquiries where an order is delayed, lost, damaged or disputed as delivered.
Nothing in these Terms transfers risk in a way that excludes or limits any rights or remedies you may have under the Australian Consumer Law.
9. Returns, Refunds & Warranties
Returns, refunds, damaged or faulty goods and warranty claims are governed by our Returns, Refunds & Warranty Policy, which forms part of these Terms.
Our voluntary change-of-mind policy operates in addition to your rights under the Australian Consumer Law.
Manufacturer warranties are also provided in addition to, and do not replace or limit, any rights you may have under the Australian Consumer Law.
10. Installation, Modification & Use of Products
Products must be installed, configured, maintained and used in accordance with the manufacturer's instructions, specifications and any applicable laws, standards or installation requirements.
Many products sold by North Adventures, particularly electrical, battery, solar and 4WD products, require appropriate technical knowledge for safe and correct installation.
Before installation, the installer should confirm matters including product compatibility, system voltage, polarity, cable sizing, circuit protection, current requirements, environmental suitability and configuration.
Where specialised skills or qualifications are required, customers should use an appropriately qualified or experienced installer.
North Adventures is not responsible for damage caused by incorrect installation, incorrect wiring, reverse polarity, incorrect voltage, inadequate circuit protection, unsuitable cabling, improper configuration, overloading, unauthorised modification, misuse or operation outside a product's published specifications, to the extent that the damage was caused by those circumstances.
This does not limit your rights where a product itself is faulty or otherwise fails to comply with a consumer guarantee under the Australian Consumer Law.
11. Vehicle Modifications, Mounting & Legal Compliance
Some products sold by North Adventures may require or involve modifications to a vehicle, caravan, camper, trailer, boat or other installation, including drilling, cutting, mounting, wiring or alterations to existing systems.
Before installing or modifying any product, customers and installers are responsible for considering the suitability of the proposed installation location and checking for concealed wiring, airbags, fuel lines, brake lines, structural components, electronic modules and other systems that could be affected by the work.
Care should also be taken to ensure that the installation does not adversely affect the safe operation, structural integrity or functionality of the vehicle or equipment.
Product weights, dimensions and specifications should be considered as part of the overall vehicle or system configuration. Customers remain responsible for ensuring that their vehicle, caravan, trailer or other equipment remains within applicable weight, payload, axle load and towing limits, including Gross Vehicle Mass (GVM), Gross Combination Mass (GCM) and other manufacturer or regulatory limits where relevant.
The availability or sale of a product by North Adventures does not necessarily mean that the product, modification or method of installation is legal or suitable for every vehicle, application or jurisdiction. Laws, regulations, registration requirements and vehicle standards may vary between Australian states and territories and may change over time.
Unless expressly stated otherwise, customers are responsible for confirming any legal, engineering, certification, registration or approval requirements that may apply to their intended installation or modification.
Any guides, articles, videos, product information or advice provided by North Adventures relating to vehicle modifications or installation are intended as general guidance and may not account for every vehicle variant, existing modification or individual installation.
North Adventures is not responsible for damage or non-compliance caused by an installation or modification that is carried out incorrectly, is unsuitable for the particular application, or does not comply with applicable requirements, to the extent that the issue was caused by those circumstances.
Nothing in this section excludes, restricts or modifies any rights, remedies or liabilities that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
11A. Third-Party Installation & Services
Unless expressly agreed otherwise, North Adventures is not responsible for work performed by independent third-party installers, technicians or service providers selected and engaged directly by the customer.
Any agreement for installation or other services entered into directly between you and an independent third party is separate from your purchase of products from North Adventures.
This section does not apply where North Adventures itself supplies or arranges the relevant service as part of your contract with us, or where liability cannot otherwise lawfully be excluded.
12. Business & Trade Purchases
North Adventures supplies products to both individual customers and businesses.
Nothing in these Terms excludes any rights available to a business purchaser where that purchaser is considered a consumer for the purposes of the Australian Consumer Law.
Where goods are purchased for commercial, trade or business use, any rights that cannot lawfully be excluded will continue to apply.
Any separate wholesale, trade account, credit or commercial supply agreement may be subject to additional terms agreed between North Adventures and the relevant business customer.
13. Intellectual Property
Unless otherwise stated, content created and owned by North Adventures, including original text, photographs, videos, graphics, logos, guides, articles and website content, is protected by applicable intellectual property laws.
You may access and use our website content for your personal and non-commercial use.
You must not reproduce, republish, distribute, modify or commercially exploit content owned by North Adventures without our prior permission, except where permitted by law.
Product images, trademarks, specifications and other materials belonging to manufacturers, suppliers or other third parties remain the property of their respective owners and are used where authorised or otherwise permitted.
14. Third-Party Tools & Links
Our website may provide access to third-party tools, services, applications or external websites.
Third-party services are governed by their own terms and privacy practices. North Adventures does not control independent third-party websites and is not responsible for their content or operation.
Where you choose to purchase products or services directly from an independent third party, that transaction is between you and the relevant third party.
Nothing in this section limits any responsibility North Adventures may have where a third-party service forms part of the service we have agreed to provide to you.
15. Shopify
Our online store is hosted by Shopify, which provides the ecommerce technology used to operate our website and process aspects of your interaction with the store.
Products purchased from North Adventures are sold by North Adventures and not by Shopify.
Your use of certain Shopify functionality may also be subject to Shopify's applicable terms and privacy practices.
16. Privacy
Our collection, use and disclosure of personal information is governed by our Privacy Policy.
Our website and ecommerce services may also involve information being processed by Shopify and other service providers used to operate our business, process payments, fulfil orders and provide our services.

17. Reviews, Feedback & User-Submitted Content
If you voluntarily submit a product review, testimonial, photograph, video or other content to North Adventures, you confirm that you have the right to provide that content.
Unless otherwise agreed, you grant North Adventures a non-exclusive, worldwide, royalty-free licence to use, reproduce and display content you voluntarily submit for purposes reasonably connected with operating, marketing and promoting North Adventures and its products.
We may moderate or remove user-submitted content where we reasonably believe it is unlawful, misleading, offensive, infringes another person's rights or is otherwise inappropriate for our website.
We will not knowingly attribute altered statements to you in a way that materially misrepresents your views.
18. Errors, Inaccuracies & Availability
Occasionally, our website may contain typographical errors, outdated information or inaccuracies relating to product descriptions, specifications, pricing, promotions, availability, shipping charges or delivery estimates.
We may correct genuine errors and update information when identified.
If a material error affects an order you have already placed, we will contact you where appropriate and explain the available options.

We will take reasonable steps to restore affected services where practicable.
21. Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
To the extent permitted by law, North Adventures is not liable for loss or damage caused by circumstances outside our reasonable control or by the customer's misuse, incorrect installation, unauthorised modification or use of a product outside its intended purpose or published specifications.
Where liability can lawfully be limited, any limitation will apply only to the extent permitted by applicable law.
We do not exclude liability for loss or damage where doing so would be unlawful.
22. Indemnity
You are responsible for loss suffered by North Adventures as a direct result of your unlawful use of our website, your infringement of another person's rights or your material breach of these Terms, to the extent that you are legally responsible for that loss.
Nothing in this section requires you to indemnify North Adventures for loss caused by our own negligence, breach of contract or unlawful conduct.
23. Events Outside Our Reasonable Control
North Adventures will not be responsible for a delay or failure to perform an obligation to the extent that the delay or failure is caused by circumstances genuinely outside our reasonable control.
These circumstances may include severe weather, natural disasters, fires, floods, transport disruptions, widespread telecommunications or technology failures, industrial action, government restrictions, public health emergencies, war or civil unrest.
Where such an event affects an order or obligation, we will take reasonable steps to minimise the impact and resume performance as soon as reasonably practicable.
Nothing in this section limits any right you may have to a refund or other remedy where required by law.
24. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or severed where modification is not possible.
The remaining provisions will continue to apply.
25. Waiver
If North Adventures does not immediately enforce a right under these Terms, this does not mean that we waive that right.
Any waiver applies only to the particular circumstances in which it is given.
26. Entire Agreement
These Terms, together with the policies expressly incorporated into them, form the agreement between you and North Adventures regarding your use of our website and purchases from us.
Nothing in this section excludes representations or rights that cannot lawfully be excluded.
27. Governing Law
These Terms are governed by the laws of New South Wales, Australia and applicable laws of the Commonwealth of Australia.
You and North Adventures submit to the jurisdiction of the courts of New South Wales and any courts with jurisdiction to hear appeals from those courts.
Nothing in this section limits any rights you may have regarding jurisdiction under applicable consumer law.
28. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, website, services or legal obligations.
The current version will be published on our website.
Changes will apply prospectively from the date they take effect and will not retrospectively alter the terms of an order already accepted unless agreed with you or permitted by law.
